Legal obstacles remain before abortion clinic could open in Wichita ...

It?s been more than three years since legal abortions were performed in Wichita, and the Kansas Legislature has since rewritten many of the state?s abortion laws.

But would any of the new laws prevent the Trust Women Foundation from opening a clinic in Wichita?

Probably not, say those on both sides of the abortion debate.

The new laws place strict restrictions on abortions performed after 22 weeks of pregnancy, and they say that minors must now get the permission of both parents before getting an abortion.

But the toughest new law ? one that would require the licensing and inspection of abortion clinics ? is tied up in court and is likely to remain there for months.

If the licensing law survives a legal challenge, the Kansas Department of Health and Environment will regulate and inspect abortion clinics the way it regulates hospitals and day-surgery centers.

?We aren?t regulating abortion clinics now because of the (lawsuit),? said KDHE spokeswoman Miranda Steele.

Doctors who perform abortions are governed by the Kansas Board of Healing Arts. That board does not perform regular inspections of doctors? offices.

While the licensing law was passed by an anti-abortion Republican Legislature and signed by an anti-abortion Republican governor, its fate could be decided by the Kansas Supreme Court, which is top-heavy with Democratic appointees.

Trust Women director Julie Burkhart said she is ?preparing for the worst and hoping for the best? as she monitors the status of the licensing law while working to open the clinic at 5107 E. Kellogg in the building where the late physician George Tiller once performed late-term abortions. The clinic was closed after Tiller was murdered in May 2009.

Burkhart said the new clinic would offer a wide range of women?s medical services, though late-term abortions wouldn?t be among them. She said she realizes the environment has changed since the day Tiller was shot.

?We do have more hurdles to jump over, but we?re well aware of that and we will do our best to move over all those hurdles,? she said.

She said that for security reasons, she could not provide information about any doctors who might perform abortions. She hopes to open the clinic in 2013.

?We would like to be open sooner rather than later,? she said, ?but we do not have a definite date.?

The lawsuit challenging the licensing law, which it refers to in court papers as ?the Regulatory Scheme,? was filed by the operators of two clinics in the Kansas City area. They contend that the law and its accompanying set of regulations would cause immediate harm to them and their clients.

?The Regulatory Scheme singles out the few Kansas physicians who provide abortions from among all other physicians in the state for the imposition of these burdensome and unjustified requirements,? the lawsuit says. ?The discriminatory treatment and the specific requirements imposed by the Regulatory Scheme are unjustified by any legitimate goal, and they will serve only to punish and irreparably harm the physicians who provide and women who seek legal and constitutionally-protected abortion services.?

The lawsuit, which was filed by the Center for Women?s Health in Overland Park and the Aid for Women clinic in Kansas City, said the closest out-of-state clinic is in Columbia, Mo., and offers only limited first-trimester abortions. The nearest provider of second-semester abortions is a Planned Parenthood clinic in St. Louis, the lawsuit said.

The lawsuit said the proposed regulations would not only invade the patients? rights to privacy, but also would impose regulations on abortion clinics that aren?t imposed on other health providers. They would, for example, require abortion clinics to replace medical assistants with physician assistants or nurses because medical assistants would no longer be able to administer medication to patients.

A Shawnee County judge in November issued a temporary restraining order that blocked the regulations from taking effect, and the state has since agreed not to try to enforce them while the case is being litigated.

Kathy Ostrowski, legislative director for the anti-abortion group Kansans for Life, said abortion clinics are not like doctors? offices and should be regulated at least to the extent that outpatient surgery centers are regulated.

?It?s kind of upsetting that there are two standards ? one for abortion and one for not-abortion,? she said. ?We have sensible laws; they?re not onerous. If you know you?re not doing anything wrong, why do you care about a medical inspection??

With the regulations now in legal limbo, she said, ?there?s no law that has anybody inspecting anything.?

Ostrowski said the state?s abortion laws would be among the strictest in the nation if the licensing law was being enforced.

?If the law was in effect, I would say we would be in excellent shape,? she said. ?Without it, I think we?re negligent.?

Stephanie Toti, a senior staff attorney for the Center for Reproductive Rights, represents the clinics in the lawsuit.

?On one hand, there?s no law that would prevent a doctor from opening up a facility that provides abortion services in Wichita,? she said. ?(But) the general hostility of the legislation and the governor toward the performance of abortions creates an environment that discourages doctors from providing those services.

?I think it?s a really discouraging climate right now for doctors.?

Toti and Ostrowski both said they expect the Kansas Supreme Court to ultimately decide whether the law can be enforced.

Ostrowski said she thinks the case was moved from federal court, where it was originally filed, to state court so it would be heard by appellate judges who are open to abortion.

?They?re aiming at the Sebelius-dominated Supreme Court,? she said. ?The only reason this was transferred is that the majority of the Kansas Supreme Court is sympathetic to abortion rights.?

Four of the seven Kansas Supreme Court justices were appointed by Democratic Gov. Kathleen Sebelius, and one was appointed by her Democratic successor, Mark Parkinson. The remaining two were appointed by Republican Gov. Bill Graves.

Toti said the case was being heard in state court because the plaintiffs are alleging that the proposed regulations violate the Kansas Constitution and Kansas laws.

?A federal court would not have jurisdiction to hear those claims,? she said. ?Federal courts do not have the power to order state officials to comply with state law; only state courts can do that.?

The Western Digital My Passport Edge ($99.99 list) fulfills a niche: ready-to-go pocket hard drives. As such, it comes in one flavor: a 500GB drive with a USB 3.0 interface. The line is built on a simpler premise: This hard drive is meant to be a convenience item to be purchased with very little effort. And that concept pretty much works. Instead of having to agonize over color choices and capacities, it's the hard drive to recommend to your friends or relatives when they "just need a hard drive."

Design and Features
The My Passport Edge is a compact, pocket-sized drive measuring about 0.5 by 3.25 by 4.5 inches (HWD), which makes it a little shorter than an iPhone 4S, a smidge wider, and almost as thin. It's thinner, but otherwise about the same size as other recent My Passport drives like the Western Digital My Passport Studio (2TB) ($299.99 list, 4 stars) and Western Digital My Passport (2TB) ($249.99 list, 3.5 stars). The drive is made mostly of matte black polycarbonate plastic, with a thin metal lid with the drive's name and a dot-based design printed on it. One edge houses the drive's USB 3.0 micro-b connector. The drive comes with a USB 3.0 cable, so it's ready to use right out of the box. There's a three-year warranty, which is better than some competitors like the Editor's Choice Seagate Backup Plus , which makes do with a two-year warranty. Both warranties are better than more basic drives that come with a one-year warranty.

The drive comes formatted for NTFS, to work with Windows systems. You can reformat the drive as HFS+ for use with a Mac, plus the drive comes with a set of Mac and Windows utilities. The drive comes with WD's SmartWare (an easy to use backup utility), WD Security (simple hardware encryption), and WD Drive Utilities (diagnostics and sleep timer). Really, if you're not planning on setting up automatic backup on Windows, you don't have to use any of the included utilities. The drive is also ready to go (after a reformat) as a Time Machine backup disk for Macs. The drive's 500GB capacity is certainly enough to backup most laptops and ultrabooks. The drive can also be used as a quick way to transfer large multi-GB files between computers.

Performance
The My Passport Edge is a speedy drive, par for the course. It took a scant 16 seconds to copy our standard 1.2GB test folder over USB 3.0. We also gained good scores on the PCMark 5 (6,158 points) and PCMark 7 (1,536 points) hard drive tests. This compared well to the current Editor's Choice for portable hard drives, the Seagate Backup Plus (which scored 6,463 on PCMark 05 and 1,498 on PCMark 7). The larger capacity My Passport (2TB) was also in the same ballpark (6,106 on PCMark 05). Essentially, if you have a USB 3.0 equipped laptop or desktop, all three choices will be speedy, much speedier than USB 2.0, which takes over forty seconds to copy the same folder on all three drives.

The Western Digital My Passport Edge is a good hard drive, and will serve you well if you get one. It's fast, and it has a good warranty. However, the Seagate Backup Plus has an interchangeable interface, which is a better choice for techie users who need to use other interface like FireWire or Thunderbolt. The Seagate also has a better dollar per GB ratio: the My Passport costs 20 cents a GB, while the Seagate is about 14 cents per GB. It's even better when you realize that some online merchants are selling the Seagate for the same $99.99 price as the My Passport Edge. Though the My Passport Edge has a better warranty, the Seagate Backup Plus still holds on to its portable hard drive Editors' Choice award due to its better bang for the buck. That said, if you're a tech savvy person who needs to convince her tech brain-dead relative to backup their files, the My Passport Edge is a stress-free recommendation you can give without hesitation.

Feds Bust Healthcare Facility in Skokie For Medicare Fraud - Skokie ...

Two owners of Skokie based Rosner Healthcare Agency, 4101 Main St., are facing federal charges after allegedly paying and receiving cash kickbacks in exchange for Medicare referral patients, federal law enforcement officials said on Tuesday. Also involved in the alleged scheme were two physicians who did business with Rosner.

All in all, federal officials charged nine people who they believe were part of the scheme.

Ana Nerissa Tolentino, 43, of Morton Grove and a registered nurse, and Frederick Magisno, 59, also of Morton Grove, were both co owners of Rosner Home Healthcare. Also charged was Edgardo Hernal, a former Rosner employee who allegedly conspired to pay kickbacks to physicians in exchange for referrals of Medicare patients that enabled Rosner to bill Medicare, authorities said.

According to the previously filed complaints, Medicare paid Rosner approximately $13 million for claims submitted for home health services between Jan. 2008 and Jan. 2012.? Neither the complaints nor indictment allege how much of Rosner?s total Medicare billings were fraudulent, authorities said.

According to the indictment, between Jan. 2008 and July 2012, Tolentino, Magsino, and Hernal conspired with others to pay kickbacks and bribes to doctors. The amount of kickbacks varied but generally ranged from $300 to $600 for each new patient?s completion of five home health visits in one cycle, and ranged between the same amounts?for the repeat admission of a previous patient in a new cycle of home health care, federal officials said. ?

All nine defendants will be arraigned in U.S. District Court on dates to be determined.

Stainless Hopes To Bring Carmageddon To Consoles - Game Informer

Stainless Games already successfully Kickstarted Carmageddon: Reincarnation, and now the creators are eyeing a console versions of the reboot.

At the Eurogamer Expo, the gaming website Explosion interviewed Stainless Games' Neil Barnden and Patrick Buckland about the Reincarnation project and managed to get them to spill the beans about possible Xbox 360 and PS3 versions of the game. When asked about plans for porting the game to consoles, Buckland responded, "We really want to get it out on consoles as well. It depends on additional funding, but we?re working on that anyway. So we?re hopeful it can happen around the same time as the PC version." Barnden added, "It?s not like we completely have to re-do all the work to bring them to consoles. A lot of the technology is already there to take it to other platforms. We?re hoping that we can bring it out sooner rather than later."

Let's hope they get the additional funding they need.

UK services output bounces back in July

LONDON (Reuters) - British services sector firms grew at their fastest pace in over a year in July as activity recovered after a public holiday hit business in June, official data showed on Friday.

Services output rose by 1.1 percent in July, the biggest gain since May 2011, after a 1.5 percent drop in June, the Office for National Statistics said. Output was 0.7 percent higher than a year earlier.

The services sector makes up more than three quarters of British GDP, and Friday's data suggests the economy made a strong start to the third quarter, after contracting by 0.4 percent in the second quarter of the year.

July's month-on-month rebound adds to strong growth in manufacturing, making it likely that the economy will leave recession after three quarters of contraction.

The bulk of ticket sales for the London Olympics will be booked in August, when the majority of events took place, though some are included in July's figures.

The ONS also reported that output per hour across all sectors of the economy fell 0.9 percent in the second quarter, contributing to a 2.6 percent fall in productivity over the previous year. Unit wage costs rose 2.0 percent on the quarter, while unit labour costs edged up by 0.3 percent, the statistics agency said.

Britain's weak productivity since the financial crisis has been a major puzzle for the Bank of England, and potentially poses inflation risks when the economy recovers.

The ONS also said that following new international guidance, it was reclassifying the remainder of banks Northern Rock and Bradford & Bingley owned by the government as central government bodies rather than public sector corporations, as they were no longer actively trading.

This means that they will add to general gross government debt, with knock-on impacts on the key measure of public sector net debt targeted by Britain's government, back-dated to 2010.

The ONS said the changes would push up government gross debt by 53.4 billion pounds in 2010/11, reducing to a 37.4 billion pound increase in 2011/12.

The change will also reduce the general government deficit by 740 million pounds in 2011/12. The changes will appear in public finances data from early 2013 onwards.

Discover 3Q profit slips, but tops Street view

BOSTON (AP) ? Discover Financial Services shares rose more than 7 percent Thursday, after the company said credit card use increased and more customers paid off their card balances on time in its fiscal third quarter. That news overshadowed a slight earnings decline in the period mostly due to it setting aside more money to cover bad loans and for a legal bill from a settlement with regulators.

The Riverwoods, Ill.-based company reported net income of $621 million, or $1.21 per share, for the quarter ended Aug. 31, after paying preferred shareholders.

That was down 3 percent from $642 million in last year's third quarter. Discover's per-share earnings in the year-ago period were $1.18, slightly lower than in the latest quarter because the company had a greater number of common shares outstanding last year. Discover repurchased about 10 million shares for $350 million in the latest quarter.

The latest quarter's earnings topped the forecast of analysts surveyed by FactSet, who expected $1.03 per share.

Revenue rose nearly 10 percent to $1.96 billion from $1.79 billion, beating analysts' forecast for $1.9 billion.

Shares of Discover rose $2.69, or 7.2 percent, to close at $39.71. The stock has risen more than 50 percent this year, in part due to improvement in customer payment habits.

Discover, which provides banking services including issuing its namesake credit cards, said total loans grew 9 percent from the year-ago quarter to $59.2 billion. Credit card loans and Discover card sales volume both increased 4 percent.

Nomura Equity Research analyst Bill Carcache said in a note to clients that the card loan growth suggests that Discover continues to gain share in the revolving credit market, which he estimated is growing at a 1 percent annual rate.

Carcache, who has a "buy" rating on the stock, characterized the company's quarterly revenue performance as a "solid" beat compared with expectations. He attributed the performance in part to better-than-expected net interest income, as money earned from loans increased 11 percent compared with a year ago, due to loan growth and lower interest expenses.

Discover Chairman and CEO David Nelms said card sales and customer payments on balances due "grew in a challenging environment while credit quality continued to improve."

The third-quarter increase in total loans came amid a slump in consumer sentiment due to the slow economic recovery and weak hiring. Discover tracks sentiment through a monthly index of spending intentions, and reported its Discover U.S. Spending Monitor fell to its lowest level of the year in August.

Credit card loans over 30 days past due fell to an all-time low, dropping to 1.81 percent of balances on an annualized basis, from 2.43 percent a year ago.

Charge-offs, or loans written off as unpaid, fell $151 million from a year ago, due to declines in delinquencies and bankruptcies.

Discover increased its provision for loan losses by 26 percent to $126 million, as the company set aside more money while making more loans.

Discover also said the yield earned from credit cards declined, due to fewer high rate balances and an increase in promotional rate balances.

Expenses jumped 29 percent to $826 million, primarily because of a $94 million increase for legal reserves due to a regulatory agreement announced last week.

Discover agreed to pay a $14 million fine and refund $200 million directly to certain customers under deal with the Federal Deposit Insurance Corp. and the U.S. Consumer Financial Protection Bureau. The agreement resolved accusations by regulators that Discover pressured credit card customers to buy costly add-on services like payment protection and credit monitoring. Discover previously established a reserve of $115.9 million in anticipation of the settlement.

Expenses, as well as revenue, are both up in part because Discover's operations have grown. The company closed in June on its $45.9 million acquisition of Tree.com Inc.'s mortgage business and began originating residential mortgages. Discover also recently added a fixed-rate private student loan product, and its first major affinity credit card.

In the latest quarter, Discover reported a 13 percent increase in transaction volume at its payment services business, to $50.3 billion. That segment, which competes with Visa and MasterCard, reported a 31 percent increase in pretax income, to $49 million.

LONDON, Sept 27 (Reuters) - Arsenal said it would stick to its policy of living within its means after the sale of star players Cesc Fabregas and Samir Nasri helped the English Premier League soccer club to more than double pretax profit.

The results are a double-edged sword for a club run on a prudent financial basis but whose fans are frustrated by the departure of top players and the lack of a trophy win since 2005.

Arsenal, which last won the Premier League title in 2004, has been overtaken by free-spending teams like Premier League champion Manchester City, bankrolled by cash from Abu Dhabi.

Chief Executive Ivan Gazidis said Arsenal was strongly placed to succeed in the long term as clubs are forced to implement rules from European soccer's governing body to rein in losses.

"We can and we will forge our own path to success and avoid the many examples of clubs across Europe struggling for their very survival after chasing the dream and spending beyond their means," Gazidis said.

"Football is moving powerfully in our direction."

Majority owned by American Stan Kroenke, Arsenal remains one of the top teams in the Premier League and has qualified for the European Champions' League for 15 seasons in a row.

However, fans of the north London club were angry when striker Robin van Persie joined rival Manchester United last month for a reported 24 million pounds.

The club reported pre-tax profit of 36.6 million pounds in the year to May 31, up from 14.8 million the previous year. Profit from player trading was 26 million pounds after Fabregas went to Barcelona and Nasri joined Manchester City.

POWER STRUGGLE

Billionaire businessman Alisher Usmanov, whose Red and White Securities vehicle owns just under 30 percent of the club, has criticised the board for selling leading players.

Despite the loss of Van Persie, Arsenal has made a promising start to the season and are in fifth place in the 20-team Premier League.

Revenue from core football activities rose to 235 million pounds. This compares with the 320 million pound revenues reported earlier this month by Manchester United, which has mined its powerful global brand to boost its coffers.

Gazidis said Arsenal would look for a significant increase in revenue from the renewal of its shirt and kit partnerships after the 2013-14 season.

Nike is the current kit supplier while the club has the name of airline Emirates on its shirts.

Manchester United signed a $559 million deal in August with General Motors to have the Chevrolet brand on its shirts for seven years from 2014.

Obama leading in Ohio, Florida and Pennsylvania

President Barack Obama has stretched his lead over Republican nominee Mitt Romney in battleground states Ohio and Florida and retains a 12-point lead in Pennsylvania, according to a Quinnipiac University/New York Times/CBS poll released Wednesday.

The president is ahead 53 to 43 percent in Ohio and 53 to 44 percent in Florida, according to surveys of likely voters conducted Sept. 18-24. In Pennsylvania, Obama leads 54-42 percent.

Peter A. Brown, assistant director of the Quinnipiac University Polling Institute, attributed the swing in Obama's favor to negative media coverage of Romney over the past few weeks but said the Republican nominee still has time to reverse the president's lead.

"Gov. Mitt Romney had a bad week in the media and it shows in these key swing states," Brown said. "The furor over his 47 percent remark almost certainly is a major factor in the roughly double-digit leads President Barack Obama has in Florida, Ohio and Pennsylvania. The debates may be Romney's best chance to reverse the trend in his favor."

If national electorate models hold, Florida and Ohio will be crucial for Romney to reach the 270 Electoral College votes needed to best Obama on Election Day. According to the Quinnipiac University poll, Romney continues to struggle with female voters, who favor Obama by 19 percentage points in Florida, 25 percentage points in Ohio and 21 percentage points in Pennsylvania. The surveys in Ohio and Pennsylvania have a margin of error of plus or minus 2.9 percent and plus or minus 2.8 percent in Florida.

Other recent polls, however, show closer races in these battleground states. A Mason-Dixon survey unveiled Sunday and conducted Sept. 17-19 showed a statistical tie between Obama and Romney in Florida. According a recent Washington Post poll, Obama leads by 8 percentage points in Ohio and 4 percentage points in Florida.

Waitrose to Launch Web TV Channels Aimed at Food Lovers

Food porn for the masses via Waitrose is set to arrive on a tablet, laptop or computer near you this Autumn as the retailer is working together with Red Bee Media to create Waitrose TV.

The plan is to provide content to inspire home cooks with 6 different channels of content. The Highlights channel will have new videos each week, and other channels will be dedicated to food, health, drink, ethical sourcing and seasonal events like Chirstmas.

Content will range from recipes, how-to guides and interviews. We?d expect it also acts as a fair promotional source for the Waitrose brand too, but if you?ve ever bought a supermarket magazine for the recipes, you?ll know that?s par for the course.

The project does have some top names from the culinary world to attract viewers. Expect to see Delia, Heston Blumenthal, Dhruv Baker, The Fabulous Baker Brothers, Silvana Franco and Sam Stern in the mix.

In a ?feat of connectivity, there will be a ?Buy ingredients? button on screen that will offer viewers a way to click through and make purchases for specific recipes or related products. no doubt this will help promote products and owning the channel means not having to wait for that lucrative TV sponsorship deal.

Whether you shop at Waitrose or not, having a how-to recipe video on a tablet in a kitchen, will be easier than trying to keep up with traditionally broadcast TV. Cops: Soldier tries to cure friend's hiccups, shoots him

A 22-year-old Fort Hood, Texas, soldier was shot in the face and died after what prosecutors say was an attempt by a fellow soldier to cure the victim?s hiccups.

Patrick Edward Myers, of Spartansburg, S.C., was charged with manslaughter in the case and remains in the Bell County Jail on $1 million bond, according?to a news release from the Killeen, Texas, police.


Police say three men were inside a Killeen residence Sunday night watching ?a football game and drinking when one of the men produced a handgun, handled it in an ?unsafe manner,? and shot the victim in the face.

An arrest affidavit obtained by the Associated Press said Myers apparently pointed a gun at the victim?s head to scare him and stop the hiccups. Myers allegedly thought the gun had dummy rounds when it discharged.

The victim was being taken by ambulance to an airfield for transport to a hospital when he died.

After a review by the Bell County District Attorney, Myers was charged with manslaughter.

A Fort Hood spokesman on Tuesday declined to release the name of the victim, saying relatives had to be notified.

UK: Petition to end discriminatory Sharia court system

We, the undersigned, support the Arbitration and Mediation (Equality) Bill introduced to the House of Lords in 2011, which aims to tackle discriminatory practices, particularly against women and children, in arbitration and mediation carried out in the UK via Sharia courts. We call on the Government to take immediate action, support the passing of the Bill and defend equality for all before the law.

Why this is important

The Arbitration and Mediation Services (Equality) Bill introduced into the House of Lords by Baroness Caroline Cox in 2011 aims to tackle the discrimination faced by Muslim women within the Sharia court system.

The Bill, which applies to all arbitration tribunals, will firmly outlaw the practice of giving women?s testimony half the weight of men?s.

The Bill?s proposals include:

  • a new criminal offence of? ?falsely claiming legal jurisdiction?? for any person who adjudicates upon matters which ought to be decided by criminal or family courts.
  • Explicitly stating in legislation that sex discrimination law applies directly to arbitration tribunal proceedings. Discriminatory rulings may be struck down under the Bill.
  • Requiring public bodies to inform women that they have fewer legal rights if their marriage is unrecognised by English law.
  • Explicitly stating on the face of legislation that arbitration tribunals may not deal with matters of family law (such as legally recognised divorce or custody of children) or criminal law (such as domestic violence).
  • Making it easier for a civil court to set aside a consent order if a mediation settlement agreement or other agreement was reached under duress.
  • Explicitly stating on the face of legislation that a victim of domestic abuse is a witness to an offence and therefore should be expressly protected from witness intimidation.

Side By Side? and at crossroads

The documentary Side By Side (2012), now at theaters, on VOD and on iTunes is an interesting exploration of photo-chemical filmmaking versus digital moving image making at a moment in time where the two co-exist. That is not to say they won?t continue to co-exist, but it?s not to say they will either. ?It depends on who you ask and the debate on which is the better medium is still a heated one.

The transition from film to digital continues to affect more people, and the movie industry itself, than most might think (above, a film projectionist in 1958, now slowly being replaced by digital projectionists). As I watched Side By Side?I did wonder, however, if it?s drawing viewers who don?t work in movies in one way or another. It is a niche subject matter in a way. Do people care about film versus digital?

With all the HD, flat screen televisions and IMAX theaters, sometimes the public appears indifferent to the quality of a picture?s appearance? I don?t know if the average consumer considers the richness and contrast film is able to provide, or the amazingly seamless visual effects offered from a digitally created or enhanced image? Maybe cinephiles, but I?m not so sure that the every day movie goer thinks about the art of what they?re watching. After all, consumers love entertaining online content that doesn?t necessarily exude beauty, but has a very wide following. In some cases much larger than movies which are theatrically released. I?m not knocking web?s presence as a current entertainment option either. Sure there?s a lot of schlock (some of it, still worthy of a view), but I think online and transmedia options are exciting.

And in contrast to online video, ?theatrical blockbusters with the endless, often gratuitous, surreal special FX, can loose their ?wow? factor by overdoing it. A little of that can go a long way. It?s no wonder 50% of the audience was texting during the entire feature at the last Michael Bay film I saw (yes I admit I went). I like my FX both campy and stunningly beautiful, but too much and I?m both worn out and bored. So as I said, I wonder, do audiences care whether something is shot on film or captured digitally? It might be that consumers care more about whether something is engaging and entertaining, then rich with film grain or so real it?s coming toward you and jumping off the screen. Me, I believe it?s all important and depends on the story.

The superhero genre with intense FX remain the king at AMCs and Loewes across the country. These films depend on digital FX and they wouldn?t be quite the same without them. The IFC Center continues to fill their venue with projects created by independent filmmakers and viewers do turn out to witness film restoration screenings at places like the Film Forum. These films remain a mix of mediums and the options need to remain open. It seems as though experiencing movies in theaters will continue (even if other venues for viewing create competition and spread out audiences). How we?re viewing them in most cinemas, however, won?t.

The documentary film, Side By Side, directed by Christopher Kenneally, produced by Keanu Reeves?and?Justin Szlasa is fascinating the way it weaves the for and against opinions on film and digital, as well as details on how the industry has changed due to the digital option and the medium?s growth. But it also addresses how this artistic and technical transition changes the finished product?s delivery and in turn, how audiences are experiencing theater movies differently, whether they realize it or not.

Reeves guides viewers through the differences between the two formats and then converses with experts in the field from Martin Scorsese,?David Fincher?(pictured here) and?Steven Soderbergh,?to Michael Chapman (cinematographer) to Anne Coates (Lawrence of Arabia editor) and Walter Murch (editor of everything) to colorists and projectionists. You can imagine, these become passionate interviews.

I was particularly interested in the way Side By Side explores movements that brought certain technologies into acceptance, such as the Dogme 95 Collective that?Lars von Trier?was a part of. I also found its coverage of the projectionists to be well thought out. Side By Side doesn?t stop at the post production process. They go into how movies are being seen in theaters then and now.

Today many theaters don?t project actual film anymore. As a committee member of New York Women in Film and Television?s (NYWIFT) Women?s Film Preservation Fund (WFPF), I know that theaters with film projection are dwindling rapidly. There are those of course that are committed and due to their archive collection or the films shown at their venue, they?ll retain a 35mm projector, and in some cases 16mm, but many no longer do. I look forward to seeing New York Film Festival?s screening of the new 4K Digital Cinema Display of Lawrence of Arabia (1962)?this coming weekend. ?This movie from 1962 won?t be arriving in canisters but by digital file (DCP) and will be projected from that.

While some venues remain faithful to having film equipment it?s getting more challenging to not only find the equipment and maintenance parts, but the experts to run them. Projectionists are less and less film projectionists. It?s becoming a lost art.?So I return to my original questions, does the average person care whether they watch a movie that?s made and/or projected from film, or if it?s a collection of many pixels configured into a picture? Maybe not, but it is my thought they should at least consider what?s happening. Like any other important piece of historical technique and/or art, it is important to preserve, especially a medium that really can?t be replicated in terms of it?s look. You might need to be a cinephile to notice, but that?s also why film preservation education and outreach is important to. While as an editor I?m working with digital files and not film, I still recognize that film preservation is just as important as the preservation of a painting and it?s method or the preservation of history as an important social and technical document of who we are.

Personally I think Side By Side is a success because it explains something that can feel complicated without treating it?s audience like they?re idiots. I also think it could be very interesting to the average movie goer, but of course that?s hard for me to perceive as someone who has an invested interested in the industry. As a biased media maker and consumer of movies, however, I do hope that film and digital image making continue to co-exist, Side By Side.
